1. Purpose of the Service
Viabilio offers a decision-support tool that allows entrepreneurs to assess the feasibility and viability of a business project based on their answers to a questionnaire, the context provided, and optional attachments. The service produces a score, a report, a certificate, and an invoice.
The service is an indicative tool. The results do not constitute financial, legal, tax or investment advice, nor a guarantee of success. They do not replace an in-depth market study or professional advice.
2. Eligibility
You must be at least 18 years old and have the legal capacity to enter into a contract. By using the service on behalf of an organization, you represent that you are authorized to bind it.
3. Acceptable Use
You agree to:
- Provide accurate information in good faith.
- Not submit illegal or defamatory content, content that infringes copyright, or third-party personal information without authorization.
- Not attempt to access the service through unauthorized means, reverse-engineer it, or compromise its security.
- Not use the service to send abusive automated content.
We may suspend access in the event of a breach.
4. Accounts and Local History
The service can operate without an account: your assessment history is stored locally on your device and you are responsible for backing it up. Paid orders are associated with a secure access token provided to you and with the email address supplied.
5. Pricing and Payments
Displayed prices are in Canadian dollars (CAD) and do not include taxes where these are not applicable. Payments are processed securely by Stripe. An official invoice is issued for each order.
Digital content delivered immediately: the report, certificate and invoice are accessible as soon as payment is confirmed. By completing your purchase, you request immediate delivery of the digital content and agree to waive any applicable right of withdrawal to the extent permitted by law.
Any dissatisfaction or technical issue can be reported to admin@viabilio.com — we will review each refund request on a case-by-case basis.
6. Intellectual Property
The platform, the "Viabilio" brand, the scoring algorithm, the documentation, and the presentation of reports are our property or that of our licensors. You retain full ownership of the information you submit as well as the report, certificate, and invoice generated for your project, which you may use freely in your business activities.
7. Viability Certificate
The certificate issued by Viabilio is an informational document confirming that a structured assessment was carried out on a given date based on the information provided. It does not bind any third party and does not constitute an official certification, a regulated label, a guarantee, or a financing decision.
8. Limitation of Liability
To the extent permitted by law, Viabilio cannot be held liable for decisions made based on the results provided, business losses, loss of profits, or any indirect damages. Our total liability to you is capped at the amount you paid for the service over the previous 12 months.
9. Availability
We strive to keep the service available at all times, without guaranteeing an absence of interruptions. Maintenance operations or incidents may occur.
10. Protection of Personal Information
The processing of your data is described in our privacy policy.
11. Changes
We may amend these terms. The version in effect is the one published on the site at the time of your use. Significant changes will be communicated.
12. Governing Law and Jurisdiction
These terms are governed by the laws of the Province of Quebec and applicable federal laws of Canada, without regard to conflict-of-law rules. Any dispute will be submitted to the exclusive jurisdiction of the courts of the District of Montreal, subject to mandatory provisions applicable to consumers.
